Keep Marise in Her Home

Keep Marise in her Home is a Facebook page started by Julie London Ferguson in her desperate attempt to save her mother, Marise, who is currently and wrongfully under the guardianship of Lutheran Services. Why? For money…if there was none, these people would be nowhere near her. Should these strangers be guardians of this beautiful sweet woman? Of course not, but our judicial system is so incredibly corrupt that the removal of an individual’s freedom happens in the blink of an eye.

I was raised Lutheran and my Mom attended St. David’s Lutheran Church in Massapequa Park every week. I wrote and called my mother’s pastor begging for his help to save her from the abusive guardianship she was locked in. I asked for help in getting her out of the assisted living facility and nursing homes she was locked up in. He refused to help. I wrote to Lutheran Services and asked for help. They ignored both my letter and phone call.  At the time, I was unaware that they were part of the problem.

I am ashamed of what people do in the name of a religion I respected and believed in. The Lutheran Services of America states on their website that their core values are as follows:

LSA’s Core Values are:

  • We are guided by God’s call to love and serve our neighbors.
  • We honor all with dignity and respect, recognizing the diversity of people, communities and ideas.
  • We are responsible stewards of resources and relationships.
  • We pursue innovative solutions to complex problems facing members and society.

How can this corporation possibly state all of this when they are complicit in taking away the God-given rights of other human beings? When a person or corporation claims they “honor all with dignity and respect”, then their behavior needs to be ethical and they must comply with the laws. One of those laws states that where there is a willing and capable family member then they need to allow that family member to be guardian and/or co-guardian and not fight that individual. They have no right to put a loving and truthful daughter of the person they claim they are helping on the defensive. They have no right to state without facts and without merit that Marise’s daughter, Julie, is not willing or capable to care for her Mom. Any negative comments that the paid staff is saying is not the truth. Why are they trying to distract from the main issue by trying to throw a loving family member under the bus? It is against the compliances of a non-profit to hang onto Marise. She needs to be living with her daughter who is more than willing, able and capable of caring for her mother.

Please listen to Julie tell her story on Sarasota Talk Radio.

This is a Facebook post by Julie London Ferguson August 8, 2014.

I was happy to get the opportunity to see my Mom twice yesterday. Early in the morning and later at night. When you do a radio program, you have to go back in time and relive a lot of the nightmare. One thing I didn’t mention on the show was not important, but I’ll mention it here. During the Guardianship test that I took and passed, the instructor was an attorney from the notoriously bad Pinellas County section. When he talked about inventory, he actually was ‘giddy’ when describing a stamp collection that was found in an elder man’s home. He was talking about how to value it. Of course he was happy – that stamp collection was going to pay HIS fees and the Guardian’s. Not be passed down in a family. This is why guardianships are called: Transfers of Wealth. My Mom’s paintings are inventory. Guardians raid people’s homes to get out valuables or do ‘inventory’. It is an extremely frightening process for the confused elderly person. Mom’s nest egg (in the five figures) that she saved so she’d be taken care of in her elderly years was gone in a week. Can you imagine how frightened we’d be to have a LOT of people forcing their way into your home – locks being changed – and people rifling through all your things? I remember the guardian telling Mom to sign for the $25.00 she was going to give her. This was after I told my lawyer that Mom had NO money for months. (Of course I spent my and my husband’s own $$’s…now in the thousands for Mom.) Mom stated: “Let me understand this…You want me to sign for my own money? No way.” I questioned how people declared incapacitated sign for their own money. Anyway, that’s what we learned in class. Family – with a history of trying to PROTECT a parent’s money…with a history of paying bills ON TIME, family members named Power of Attorneys and want to take care of their own parent should be able to. Anything less is a crime to humanity and our most vulnerable citizens. Instead of seeing our elderly as brave souls who have weathered life’s storms and deserve respect, the bad see them as ‘cash cows’. I believe that is why once in a guardianship, they never get out. No one gets out.

San Bernardino County: Financial elder abuse continues after death of elder

If you think that this cannot happen to you, your loved ones, a relative, a close family member, think again. What is happening in this country is so immoral, so outrageous, so sick that our minds just cannot comprehend that this is going on everywhere. The abuse of the elderly and disabled is being perpetuated by individuals whose only goal is greed. I believe these people have somehow managed to compartmentalize their beliefs or values in order to commit these most heinous acts. For many people, when it comes to money they will find a way to excuse their unconscionable behavior.

“Compartmentalization is an unconscious psychological defense mechanism used to avoid cognitive dissonance, or the mental discomfort and anxiety caused by a person’s having conflicting values, cognitions, emotions, beliefs, etc. within themselves. Compartmentalization allows these conflicting ideas to co-exist by inhibiting direct or explicit acknowledgement and interaction between separate compartmentalized self.”

The moral fabric of a society generally share a standard dignity through high morals making the moral fabric a keystone; keeping the base of society and the morals it holds high. Ours has fallen into terrible disrepair. We need to rise up now against these monstrous actions and stop it before it is too late. As an individual we can feel so overwhelmed by what is going on and act as if there is nothing we can do. However, instead of sitting idly by and waiting for someone else to fix this problem, we all need to ask the question “What can I do to stop this ?” and “How can I not try to stop this?”

Please read this article in its entirety and help by sending an email protesting what was done to this woman and her family. It will take only a few minutes of your time.  Do it for someone you love.

Today marks one year since the passing of Carol Hahn. Friends remember Carol as a helpful and giving person, bringing fresh-baked cookies to social events and giving rides to ailing members of her church. Elder advocates remember Carol as the impetus behind California’s landmark Assembly Bill 937 (2013) to clarify personal rights.

In June 2010, Carol was taken from her home and hidden from family at assisted living facility Wildwood Canyon Villa. When Carol called her daughter for help, Wildwood confiscated Carol’s cell phone and moved her into a secured unit. Wildwood’s Assistant Director told family:

Carol Hahn is allowed no visitors and no phone calls.

In August 2010, San Bernardino County Superior Court appointed attorney Mark J. Andrew Flory to represent Carol. The court instructed Flory to investigate Carol’s situation and facilitate visitation with family. Flory did not follow the court’s instructions. Carol remained isolated from her loved ones.

In September 2010, Community Care Licensing cited Wildwood Canyon Villa for violating Carol’s right to visitation. The citation stated Carol’s right to:

To have his/her visitors, including ombudspersons and advocacy representatives permitted to visit privately during reasonable hours and without prior notice, provided that the rights of other residents are not infringed upon.

Community Care Licensing did not enforce the regulation. Carol remained isolated from her loved ones.

In November 2010, Flory’s report to the court demonstrated his failure to understand personal rights and licensing regulations.

It is unclear to me why the facility was cited…

In September 2011, the court issued a restraining order against continued isolation abuse. Carol was allowed to see her loved ones after fifteen months of isolation.

In 2010 – 2012, Flory opposed Carol having a bed, rather than sleeping on a mattress on the floor. Community Care Licensing cited the violation in September 2011. Wildwood Canyon Villa did not provide Carol with a bed until March 2012. Carol slept on a mattress on the floor for eighteen months.

In 2010 – 2013, Flory opposed Carol receiving routine medical care. For nearly three years, Carol was limited to palliative care through hospice. Carol was not allowed treatment from her long-term rheumatologist for very painful rheumatoid arthritis. Carol was not allowed treatment for Alzheimer’s disease that stole her memories and brought increasingly violent agitation.

Silverado Senior Living Sued for Falsely Imprisoning 93 year old Ruby Peterson of Texas

Ruby S. Peterson is a 93-year-old woman who is being held against her will at Silverado Senior Living. This is what is happening to the elderly all across the country. Candice Schwager of Texas is the lawyer working night and day trying to free her and let her go home. Ruby gave her daughter, Carol Ann Manley, Power of Attorney. Although Ruby is not incapacitated and does not have a guardian, it appears that Carol Ann, using Ruby’s two million dollar estate, has somehow managed to get Silverado to conspire with her to keep Ruby locked up against her will. In a video where Ruby Peterson tells her story very clearly she speaks about how two women stripped her naked and put her in the shower and washed her entire body. She states that she is able to bathe herself. In my opinion, that is sexual assault. This is another one of the most horrifying cases of elder abuse. Mary Giordano, elder care attorney with Franchina and Giordano of Garden City, NY did the same thing to my mother. We all need to raise our voices against this abuse before it happens to us.

Emergency Injunction against Silverado Senior Living & Carol Ann Manley of Sugarland

by Candice Schwager

I am guessing that Silverado Senior Living is accustomed to “getting away with murder” in the most figurative sense at a minimum by the foolish way they are choosing to respond to this Application for Emergency Injunction to release Ruby Peterson, currently being held against her will and forcibly drugged with dangerous drugs (prohibited for use with elderly by FDA black box warning) as she suffers untold horrors, including at least one sexual assault in which two strangers took her to another area of the facility (knowing she could bathe on her own), stripped her nude at 93 years of age, and bathed her like a dog as she prayed to God for the humiliation to end. She cried in desperation not knowing if she would even survive until morning. These “monsters” (my opinion but well grounded in fact) want that brushed aside and never seeing the light of day. Please help ensure that Ruby’s voice is heard loud and clear so that Ruby is FREED!  This could someday save the life of someone you love by stopping this quasi-criminal activity in its tracks now!  Whatever you do, do not sit back and think someone else can do it for you. God gave you a voice and if you can use it for someone without one, I hope you will consider that it costs nothing to share. I do not have enough information to say this is racketeering, but it borders it. What do you call a group of professionals exploiting the elderly and imprisoning them to take their life savings, which in Ruby’s case is substantial. She and her late husband saved and lived meagerly, which is why you see the vultures trying to pick every piece of flesh off her bones before she’s even gone.
